Terms of Service

Key terms

  • Automatic renewal. Your Subscription costs $29 a year plus any tax, and it renews automatically each year until you cancel. You can cancel at any time on your account page. Cancelling stops the next renewal; Finite Phone keeps working until the end of the year you have paid for and is removed from your phone 48 hours after that (sections 3 and 7).
  • Refund. If you ask within 30 days after your first payment, we will refund that payment in full, once per customer. A refund ends your Subscription, and Finite Phone is then removed from your phone (section 4).
  • Removal takes 48 hours. There is no setting on your phone that turns Finite Phone off. You ask for removal on your account page, and Finite Phone is removed 48 hours later, at the phone's next check-in. We will not shorten that wait at your request. Section 7 sets out the exceptions; for example, a request made in the first 24 hours after setup takes effect at the phone's next check-in. A factory reset removes Finite Phone at once and erases everything on the phone.
  • Hidden apps. Apps that are not on our list of approved apps are hidden, not deleted, and they come back with their data when Finite Phone is removed (section 6).

This summary is for convenience and does not change the sections it summarizes. If they differ, the sections govern.

1. Agreement and eligibility

1.1 These Terms. These Terms of Service (these "Terms") are an agreement between you and Adesse, LLC, a Washington limited liability company doing business as Finite Phone ("we," "us," or "our"). They govern your Finite Phone subscription (your "Subscription") and your use of the Finite Phone app (the "App"), our websites at finitephone.com and my.finitephone.com, and the related services we provide (together, "Finite Phone"). You accept these Terms when you subscribe. Our Privacy Policy explains how we handle personal information. It is not part of these Terms.

1.2 Who may subscribe. You may subscribe only if you are at least 18 years old and live in the United States.

1.3 Your own phone only. You may set up Finite Phone only on a phone that you own, or that you have the owner's permission to manage with device-management software, and that you yourself use. You may not set up Finite Phone on a phone that someone else uses, or use Finite Phone to monitor, restrict, or manage another person. Finite Phone is not designed for children and is not a parental-control service.

1.4 Your permission. By completing setup, you give us permission to make the App your phone's device owner and, through it, to: hide the apps that are not on our list of approved apps, keeping their data on the phone; block websites in the phone's Chrome browser; limit app installs to Google Play and, on a Samsung Galaxy phone, the Galaxy Store; apply the restrictions described in section 6 and the settings you choose under section 8; update the App, the Approved List, and the Block List automatically, without asking you each time; and remove Finite Phone as section 7 describes. This permission lasts until Finite Phone is removed from your phone. Requesting removal on your account page is how you withdraw it, and the withdrawal takes effect when the removal takes effect under section 7. You may also reset your phone to its factory settings at any time, which removes Finite Phone at once.

2. The service

2.1 What Finite Phone is. Finite Phone is a subscription service that limits the apps and websites available on your phone. During setup, the App becomes the phone's device owner, a management role that Android provides. In that role, the App hides apps that are not on our list of approved apps (the "Approved List"), blocks the websites on our list of blocked websites (the "Block List") in the phone's Chrome browser, and provides tools you control, which are described in section 8.

2.2 What Finite Phone is not. Finite Phone is not a phone, a carrier, or a mobile service plan. It is not a security, privacy, or parental-control product, and it is not medical or mental health care. You keep your own phone, carrier, phone number, and Google account.

2.3 Requirements. Finite Phone works only on a Google Pixel 6 or newer, or a Samsung Galaxy phone, running Android 14 or newer. The phone must have a single user, with no work profile and no private space. Setup requires a computer running Windows, macOS, or ChromeOS, with a current version of Google Chrome or Microsoft Edge, and a cable that connects the computer to the phone. You are responsible for your phone, your computer, your internet and mobile data service, and their costs.

2.4 Changes to the service. We may change Finite Phone over time, including by adding, changing, or removing features. We may change the Approved List and the Block List at any time (section 8.8). If we discontinue Finite Phone entirely, section 11.3 applies.

3. Subscription, renewal, and payment

3.1 Price. Your Subscription is billed yearly, in advance. The price is the amount shown at checkout, currently $29 a year, plus any sales tax that applies. Any tax we charge is shown at checkout before you pay. There are no other fees.

3.2 Automatic renewal. Your Subscription renews automatically for another year at the end of each Subscription Year unless you cancel before the renewal date. At each renewal, we will charge your payment method the annual price then in effect, plus any applicable tax. By subscribing, you authorize these yearly charges until you cancel. A "Subscription Year" is the one-year period that begins on the date of your first payment or on a renewal date.

3.3 Renewal reminders. Before each renewal, we will email you a reminder that states the renewal date, the amount that will be charged, and how to cancel.

3.4 Price changes. We may change the annual price for future Subscription Years. If we do, we will email you notice of the new price at least 20 days before the renewal date on which it first applies. A new price never applies to a Subscription Year you have already paid for. If you do not want to pay the new price, you may cancel before the renewal date. If you are charged a higher price and you cancel within 14 days after that charge, we will refund the unused part of that Subscription Year.

3.5 Payment. Payments are processed by Stripe, Inc. You authorize us and Stripe to charge your payment method for each amount due under these Terms. You can update your payment method from your account page. We do not receive or store your full card number.

3.6 Failed payments. If a renewal payment fails, Stripe may retry the charge, and Finite Phone keeps working while it does. If the payment has not been collected within 30 days after the first failed attempt, or Stripe stops retrying sooner, your Subscription ends for non-payment and Finite Phone is removed from your phone as described in section 7.5. If your Subscription becomes active again before that removal takes place, because the payment is collected or you subscribe again, the removal is cancelled.

3.7 Cancelling. You may cancel your Subscription at any time on your account page, without giving a reason. If you cannot cancel on your account page for any reason, email us from the address on your account and we will cancel it for you. Cancelling stops all future renewals at once. Your Subscription and Finite Phone continue until the end of the Subscription Year you have paid for. If you cancel while a renewal payment is failing (section 3.6), your Subscription ends at once, because the Subscription Year you paid for has already ended, and the payment is not retried. Except as section 4 provides, we do not refund any part of a Subscription Year after you cancel. Cancelling your Subscription does not remove Finite Phone from your phone. When your paid Subscription Year ends, Finite Phone is removed from your phone 48 hours later, as described in section 7.5.

4. Refunds

4.1 30-day refund. If you ask within 30 days after your first payment, we will refund that payment in full. Ask by email to support@finitephone.com from the address on your account. You do not need to give a reason. A request is on time if we receive it within those 30 days. The refund is available once per customer: if you have received it before, under any account, we may decline another. A renewal does not start a new 30-day period. We will issue the refund promptly to the payment method you used.

4.2 Effect of a refund. A refund of a Subscription Year, in full or in part, ends your Subscription when it is issued. Finite Phone is then removed from your phone 48 hours later, or at the phone's next check-in if the refund is issued within 24 hours after setup (section 7).

4.3 Other refunds. We do not give refunds except under section 4.1, section 3.4 (a price increase), section 11.2 (if we end your Subscription), section 11.3 (if we discontinue Finite Phone), section 15.6 (an outage of more than 30 days), or where the law requires one.

4.4 Payment disputes. If you have a question or concern about a charge, contact us first. If you dispute a charge with your bank or card issuer and the payment is reversed, we may end your Subscription under section 11.2, and Finite Phone is then removed from your phone as described in section 7.5.

5. Setup

5.1 How setup works. You set up Finite Phone from your account page, in a web browser on your computer, with your phone connected by cable. Setup requires you to turn on Developer options and USB debugging on the phone and to remove every account from the phone, including your Google account. Setup may stop apps that hold an account so that the account can be removed. Setup then installs the App on the phone, without hiding anything, and you choose a web mode (section 8.6). Before the App becomes the device owner, the setup page shows you which apps will be hidden and which will stay, and asks you to confirm. Setup then makes the App the device owner, applies the settings described in section 6, turns off USB debugging and Developer options, and restarts the phone. You then add your Google account back to the phone. Setup does not erase the phone.

5.2 Other users and profiles. If your phone has a second user, a work profile, or a private space, you must delete it before setup. Deleting it erases its apps and data.

5.3 Before you start. Back up your phone and make sure anything you rely on is synced or saved. Removing accounts has effects we do not control. For example:

  • an app whose account can be removed only by uninstalling the app must be reinstalled and restored from that app's own backup;
  • Google Wallet deletes digital car keys when the Google account is removed, and you must add them again;
  • passkeys and authenticator codes that are not synced to an online account may not come back; and
  • RCS messaging may take some time to start working again.

The phone may also ask to send the App for a security check, because setup installs it from the computer instead of from Google Play. Setup continues whichever you choose.

5.4 The apps that will be hidden. Read the setup page's lists carefully. When setup finishes, every app the page lists as hidden is hidden, including any app you rely on for your health, your safety, your work, or signing in to other services. If you need one of those apps, ask for it on that page before you continue (section 8.7). A hidden app comes back only if we add it to the Approved List, if it is approved and you install it again from Google Play, if it is one you blocked and you unblock it (section 8.4), or if Finite Phone is removed from your phone.

5.5 If setup stops. If setup stops before it finishes, USB debugging may still be on. You can turn it off in your phone's settings, and you can start setup again. If setup stops before the App becomes the device owner, the App may stay on the phone without controlling anything, and you can uninstall it.

5.6 Information. The setup page reads information from your phone in your browser. Some of that information is sent to us, as our Privacy Policy describes.

6. What Finite Phone does on your phone

6.1 Device owner. While Finite Phone is on your phone, the App is the phone's device owner. Setup also gives the App permission to see which app is on the screen and to change certain system settings, and the App uses these permissions on the phone to provide the features described in these Terms. Android shows on the phone that it is managed by Finite Phone, and the lock screen says "This device belongs to Finite Phone." Android may also show "Updated by your admin" when the App updates; we cannot change or hide that notice.

6.2 Hidden apps. Any app you installed that is not on the Approved List is hidden. A hidden app is not deleted. It does not appear on your home screen or in your app list, and it cannot be opened or run, but the app and its data stay on the phone. An app you install later is hidden in the same way. Apps that came with your phone are not hidden, except certain built-in apps that we always hide, which the setup page lists before you confirm, and a few built-in apps that start hidden until you turn them on in the App. If an app leaves the Approved List, it is hidden; if it is added, it comes back. Every hidden app comes back, with its data, when Finite Phone is removed.

6.3 Apps from Google Play and the Galaxy Store. Installing apps from sources other than Google Play, or the Galaxy Store on a Samsung Galaxy phone, is turned off. An app on the Approved List that was not installed from Google Play or the Galaxy Store, and that did not come with the phone, is hidden like an app that is not on the list.

6.4 Websites. Chrome is the only web browser on the Approved List. The App manages Chrome using the settings Chrome provides for managed devices. Websites on the Block List do not open in Chrome. Google searches in Chrome may be set to SafeSearch, which you cannot turn off, and Chrome's suggested articles on new tabs are turned off. The App is also the phone's default browser app, so that a link you tap in another app is checked against the Block List on the phone before it opens in Chrome; a blocked link shows a Finite Phone screen instead. These checks happen on the phone. The Block List applies only to Chrome and to links; it does not reach content inside other apps.

6.5 The Google app. The Google app stays on the phone, because the phone's assistant needs it. When its Discover feed opens, a Finite Phone screen opens over it.

6.6 Settings that are turned off. While Finite Phone is on your phone, you cannot start the phone in safe mode, add users or profiles, install apps from sources other than Google Play or, on a Samsung Galaxy phone, the Galaxy Store, change the date, time, or time zone, or change the phone's default apps. Android's settings will not let you uninstall the App, stop it, or clear its data. On a Pixel, the search bar on the home screen searches the apps on your phone rather than the web.

6.7 What Finite Phone does not block. Finite Phone does not prevent a factory reset, block Android system updates, or block phone calls, including emergency calls. Whether an emergency call connects depends on your phone, Android, and your carrier. Finite Phone does not hide or block Google's Find My Device, and it keeps Android's backup service turned on. Setup turns off USB debugging and Developer options; you may turn them back on, and Finite Phone does not prevent it.

6.8 Updates and data use. The App updates itself automatically, and you cannot decline its updates. An update may change what Finite Phone does on your phone; if it changes what Finite Phone controls, we will describe the change in the App. Updates usually install while the phone is charging with its screen off. Changes to the Approved List and the Block List reach your phone automatically. Your phone checks in with our servers about every 15 minutes, and also when you open the App while connected to the internet (each, a "check-in"). The App uses your internet connection, including mobile data, for check-ins and downloads, and your carrier's data charges apply.

6.9 What we can do remotely. From our servers, we can change the Approved List and the Block List, update the App, apply settings you choose on your account page, and remove Finite Phone from your phone. The App has no function that lets us see your screen, read your messages, track your location, lock your phone, or erase it. Android's settings may list locking the screen and erasing all data among the App's permissions, but the App does not use them.

6.10 Maintenance functions. Some maintenance functions require both a cable connection to your phone and a key that only we hold. We use them only with you, at your request, and never to shorten the Waiting Period.

7. Removing Finite Phone

7.1 The Waiting Period. There is no setting on your phone that turns Finite Phone off. To remove Finite Phone, you request removal on your account page. Except as sections 7.3 and 7.5 provide, Finite Phone is removed from your phone at its first check-in after the 48 hours that follow your request (the "Waiting Period"). You agree to the Waiting Period, and we will not shorten or waive it at your request, including through customer support. You acknowledge that the Waiting Period is a central feature of Finite Phone that you chose when you subscribed, and that its purpose is to give you time to reconsider before Finite Phone's limits end.

7.2 How removal works. When you request removal, we email you to confirm. Until the Waiting Period ends, you can cancel the request with one click on your account page. A new request starts a new Waiting Period. Every removal under this section 7 takes place at the phone's first check-in after the removal is due. If the phone is not connected to the internet at that time, the removal takes place when it next connects. Removing Finite Phone does not cancel your Subscription; you cancel your Subscription separately (section 3.7).

7.3 The first 24 hours. If you request removal within 24 hours after setup, the Waiting Period does not apply, and Finite Phone is removed at the phone's next check-in. The same applies if your Subscription ends within 24 hours after setup, for example because of a refund.

7.4 Factory reset. A factory reset removes Finite Phone from your phone at once. It also erases all data on the phone. You may reset your phone at any time without asking us. Data that your Google account backs up can be restored afterward.

7.5 When your Subscription ends. If your Subscription ends for any reason, including cancellation at the end of a paid Subscription Year, non-payment, a refund, or termination by us, Finite Phone is removed from your phone 48 hours after the Subscription ends, or at the next check-in if the Subscription ends within 24 hours after setup. Unlike a removal you request, this removal cannot be cancelled with one click; it is cancelled only if your Subscription becomes active again before it takes place, for example because a failed payment is collected or you subscribe again. After the paid time on a cancelled Subscription has run out, or after a Subscription has ended for non-payment, your account page offers an option to remove Finite Phone at the phone's next check-in without waiting for the rest of the 48 hours. That option is not available when a Subscription ends before the end of the time paid for, for example because of a refund.

7.6 A phone you no longer have. If you tell us on the setup page that you no longer have a phone, that phone is released from your Subscription at once, so that you can set up another. If the phone checks in again later, Finite Phone is removed from it 48 hours after you told us, and not sooner.

7.7 No other early removal. Except as this section 7 provides, or as the law requires, we will not remove Finite Phone from your phone before the Waiting Period ends, whether you ask us directly or through customer support. Apart from those exceptions, a factory reset is the only way to remove Finite Phone sooner.

7.8 What removal does. When Finite Phone is removed, every app it hid comes back with its data, the restrictions described in section 6 are lifted, the Block List and Chrome's managed settings are cleared, any running lock, Second Thought, and In gray setting ends, and the App stops being the phone's device owner and deletes its own data from the phone, except a record that the removal took place. Android does not allow the App to uninstall itself, so it stays on the phone until you uninstall it, and it asks you to do so the next time you open it. Settings stored with your account remain there and are restored if you set up Finite Phone again.

8. Your settings and requests

8.1 How changes take effect. While your Subscription is active, you can make Finite Phone stricter at any time, and those changes take effect quickly. Changes that loosen Finite Phone are delayed as this section describes. During a delay, you can cancel the change. We will not shorten a delay at your request.

8.2 Lock. In the App, you can lock an app or a website so that it does not open. You choose when the lock starts and how long it lasts, from 15 minutes to 24 hours. Once a lock is set, it ends at the time it was set to end, and not before: you cannot end it early, restarting the phone does not end it, and we will not end it. A lock scheduled to start later cannot be cancelled, and if you start a scheduled lock early, it still ends at the time it was set to end, so it may last longer than 24 hours. A lock ends early only if Finite Phone is removed from your phone or the phone is reset. You can lock up to 50 websites at once. Lock is not offered for apps in the groups listed in section 8.4 or for the phone's basic apps, such as its phone, messaging, contacts, camera, clock, calendar, and settings apps.

8.3 Second Thought and In gray. Second Thought adds a pause before a chosen app opens. Turning it on for an app, or choosing a firmer level, takes effect at once. Turning it off for an app, or choosing a gentler level, takes effect 24 hours after you ask, and you can cancel the change during that time. In gray shows a chosen app in black and white, and you can turn it on or off at any time.

8.4 Blocking apps. On your account page, you can block an app on the Approved List, which hides it on your phone. A block takes effect at the phone's next check-in. Unblocking an app takes effect 48 hours after you ask, including during the first 24 hours after setup, and you can cancel the request during that time. If you set up Finite Phone again before an unblock takes effect, the request ends, and you can ask again after setup. The phone's calling and messaging apps, and apps in the groups we classify as essentials, medical, health and fitness, finance, maps and navigation, and tools, cannot be blocked.

8.5 Blocking websites. You can block up to 50 websites of your own, from your account page or from the App. A block takes effect at the phone's next check-in, or at once if you add it in the App while the phone is connected to the internet. You can unblock a website only on your account page. Unblocking takes effect 48 hours after you ask, including during the first 24 hours after setup, and you can cancel the request during that time. If you set up Finite Phone again before an unblock takes effect, the request ends, and you can ask again after setup. Our own websites, Google's account sign-in pages, and google.com cannot be blocked.

8.6 Web modes. Chrome on your phone runs in one of two modes, which you choose during setup. In Standard mode, websites on the Block List do not open, and other websites do. In Strict mode, only the websites on our approved list for Strict mode, and the websites we approve at your request, open; a page that another website relies on, such as a bank's page that confirms a card payment, may not open unless it is approved. You can change the mode only on your account page. A change to Strict mode takes effect at the phone's next check-in. A change from Strict mode to Standard mode takes effect 48 hours after you ask, or at the next check-in if you ask within 24 hours after setup, and you can cancel the request during that time. When you ask us to add a website in Strict mode, it is approved at once if it is on our list of pre-approved websites, refused at once if it is on the Block List, and otherwise reviewed by us.

8.7 Requests. You can ask us to add an app to the Approved List from the setup page, your account page, our website, or the App, and to review a website you believe is blocked by mistake from your account page or the App. We decide requests through our own review and with automated tools, including artificial intelligence services provided by others, and some requests are decided automatically under rules we set. Whether to add an app or unblock a website is our decision. Nothing is unhidden or unblocked until we approve it. Your account page shows the status of the requests made with the email address on your account, and we email you our decision on an app request. You never need to tell us why you want an app. Please do not include health information in a request; we do not need it.

8.8 The Approved List and the Block List. We maintain the Approved List and the Block List and may change them at any time. They are not part of these Terms. No list can catch every app or website, a website can change after we review it, and something may be blocked that should not be. Some of your settings and lists are stored with your account, so that they are restored if you set up Finite Phone again.

9. Your account

9.1 One phone per Subscription. Each Subscription covers one phone at a time. While a phone is set up on your Subscription, you cannot set up another phone until Finite Phone has been removed from the first one or you tell us that you no longer have it (section 7.6). You may set up the same phone again on the same Subscription after Finite Phone has been removed from it or the phone has been reset.

9.2 Sign-in and security. You sign in to your account with a link sent to your email address or with your Google account. Keep your email and Google accounts secure. Anyone who can sign in to your account can change your settings, request removal, and cancel your Subscription. We email you when a removal is requested.

9.3 A lost phone. If you lose your phone, Google's Find My Device works as it does on any Android phone.

10. Use of Finite Phone

10.1 License. Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable license to install and use the App on your phone while your Subscription is active and until Finite Phone is removed from your phone under section 7.

10.2 Restrictions. You may not copy, modify, distribute, sell, or lease the App; reverse engineer it, except to the extent the law allows despite this restriction; use Finite Phone on a phone you are not permitted to manage under section 1.3; interfere with, disrupt, or overload our servers or another customer's use of Finite Phone; access our systems except through the websites and the App; or send requests in bulk or by automated means. Nothing in these Terms limits your right to reset your phone or to remove Finite Phone as section 7 describes.

10.3 Open-source software. The App includes open-source software licensed under its own terms, listed at finitephone.com/notices/. Those licenses govern that software, and nothing in these Terms limits your rights under them.

10.4 Our rights. Finite Phone, including the App, the Approved List, the Block List, our websites, and our names and logos, belongs to us or our licensors. These Terms do not give you any rights in them other than the license in section 10.1.

10.5 Third-party apps and services. The apps on the Approved List are made by others and are governed by their own terms. Google's services on your phone are governed by Google's terms. We are not responsible for third-party apps or services, and an app's presence on the Approved List is not a statement that the app is safe or will keep working.

10.6 Feedback. If you send us suggestions about Finite Phone, you give us a non-exclusive right to use them without any obligation to you.

11. Ending your Subscription

11.1 By you. You may cancel your Subscription at any time (section 3.7) and request removal of Finite Phone at any time (section 7).

11.2 By us. We may end your Subscription only for cause: non-payment (section 3.6); a phone set up in violation of section 1.3; fraud; a payment reversed after a dispute (section 4.4); a material breach of section 10.2; or where the law requires us to. We will email you when we do, with the reason, and Finite Phone is then removed from your phone as section 7.5 describes. We will not end your Subscription because of the requests you make, what you say about us, or how much you use Finite Phone. If we end your Subscription for any reason other than non-payment, fraud, a reversed payment, or a breach of section 1.3 or 10.2, we will refund the unused part of your Subscription Year, and we will do the same if a court or arbitrator finds that we had no cause to end it.

11.3 If we discontinue Finite Phone. If we decide to stop offering Finite Phone, we will email you at least 30 days in advance, refund the unused part of your Subscription Year, and, before we stop operating the service, instruct your phone to remove Finite Phone. If your phone does not receive that instruction for any reason, a factory reset will still remove Finite Phone.

11.4 After your Subscription ends. When your Subscription ends, Finite Phone is removed as section 7 describes, and your license under section 10.1 ends when it is removed. Information we keep afterward, and for how long, is described in our Privacy Policy. Sections 4, 7, 10.3 through 10.6, 11.4, 12, 13, 14, and 15, and any amounts owed, survive the end of your Subscription.

12. Disclaimer of warranties

12.1 As is. WE MAKE NO WARRANTIES ABOUT FINITE PHONE EXCEPT THOSE STATED IN THESE TERMS. OTHERWISE, FINITE PHONE IS PROVIDED "AS IS" AND "AS AVAILABLE," AND, TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. We do not promise that Finite Phone will be uninterrupted or error-free, that it will hide or block every app or website it is meant to, or that it will not hide or block something it should not. This section does not affect any warranty or right that the law does not allow us to disclaim.

12.2 Not health care. Finite Phone is a tool for managing the apps and websites on your phone. It is not medical, psychological, or other health care, and it is not intended to diagnose or treat any condition.

12.3 Google and others. Your phone is provided by its maker, and Android, Google Play, Chrome, and Google's other services are provided by Google LLC, each under its own terms. Either may change them in ways that affect Finite Phone. Google, Pixel, Android, Chrome, and Google Play are trademarks of Google LLC. Samsung and Galaxy are trademarks of Samsung Electronics Co., Ltd. Finite Phone is not affiliated with, sponsored by, or endorsed by Google or Samsung.

13. Limitation of liability

13.1 Excluded damages. TO THE FULLEST EXTENT THE LAW ALLOWS, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATING TO THESE TERMS OR FINITE PHONE, INCLUDING LOSSES THAT RESULT FROM AN APP OR WEBSITE BEING HIDDEN, BLOCKED, OR LOCKED, OR FROM ACCOUNTS BEING REMOVED DURING SETUP.

13.2 Limit on total liability. TO THE FULLEST EXTENT THE LAW ALLOWS, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR FINITE PHONE IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR FINITE PHONE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR $100.

13.3 Exceptions. Sections 13.1 and 13.2 do not apply to liability for death or personal injury, fraud, gross negligence, or willful misconduct; to refunds or arbitration fees we owe under these Terms; or to any liability the law does not allow us to limit, including statutory damages and attorneys' fees that the law entitles you to recover.

14. Dispute resolution and arbitration

14.1 Notice of dispute. Before either of us starts an arbitration or a lawsuit about a Dispute (defined in section 14.2), the one bringing the claim must send the other a written notice of dispute and try in good faith to resolve it informally for 30 days. Your notice must be signed by you personally, even if a lawyer represents you (your typed full name at the end of an email is enough), and must include your name, the email address on your account, a description of the dispute, and what you want. Each person must send their own notice. Send it by email to support@finitephone.com, or by mail to the address in section 16. We will send our notice to the email address on your account. All limitation periods are paused from the day a complete notice is sent until the Dispute is resolved or withdrawn, whether informally, in arbitration, or in court. Not sending a notice does not waive any claim; the claim only waits until the notice has been sent and the 30 days have passed. This section does not apply to a claim brought in small claims court.

14.2 Agreement to arbitrate. You and we agree that any dispute, claim, or controversy arising out of or relating to these Terms, Finite Phone, or how we handle your personal information (a "Dispute") will be resolved by binding individual arbitration, and not in court, except as sections 14.3, 14.4, and 14.9 provide. You and we give up the right to go to court to resolve a Dispute and the right to a jury trial. In arbitration, a neutral arbitrator decides the Dispute instead of a judge or jury, and a court's review of the decision is limited. This agreement to arbitrate is governed by the Federal Arbitration Act.

14.3 Exceptions. Either of us may bring an individual claim in small claims court instead, in the county where you live or in King County, Washington, at your choice, if the claim qualifies. If you bring a claim of sexual assault or sexual harassment, you may bring it in court, and section 14.8 does not apply to it. This section 14 does not apply to any claim that the law does not allow to be arbitrated.

14.4 Public injunctive relief. If you ask for public injunctive relief (an order whose main purpose is to protect the public, not only you), a court, not an arbitrator, will decide that request after the arbitration of your other claims is complete, and the court case will be paused until then.

14.5 Who decides. The arbitrator decides all questions about the scope, interpretation, applicability, and enforceability of this agreement to arbitrate, except that a court decides whether an agreement to arbitrate was formed and any question about section 14.3, 14.4, or 14.8.

14.6 Rules and administrator. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules and, where they apply, its Mass Arbitration Supplementary Rules, in each case as in effect when the arbitration is filed. The rules are available at adr.org. The arbitrator may order the exchange of information as those rules provide and as needed for a fair hearing. If the AAA declines to administer an arbitration because we have not paid fees we owe, you may bring your claim in court. If the AAA cannot or will not administer an arbitration for any other reason, the parties will agree on a substitute administrator, or a court will appoint one.

14.7 Fees and hearings. Your filing fee will not exceed the amount the AAA's consumer fee schedule assigns to consumers, and we will pay all other AAA and arbitrator fees. We will not seek our attorneys' fees or costs from you unless the arbitrator finds your claim frivolous or brought for an improper purpose. A claim for $25,000 or less will be decided on written submissions unless you ask for a hearing, or we ask for one and the arbitrator agrees. Hearings take place by video or telephone unless the arbitrator decides that a hearing must be in person. An in-person hearing takes place in the county where you live, or at another place we both agree to.

14.8 Individual claims only. You and we may bring claims against each other only individually, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. No arbitrator may hear a class, collective, or representative claim, or combine the claims of more than one person, except as the AAA's Mass Arbitration Supplementary Rules provide for the administration of individual cases. The arbitrator may award any relief that a court could award to an individual under applicable law, but only to the extent needed to resolve the claimant's individual claim, and must issue a written decision explaining the essential findings and conclusions. If a court finally decides that this section 14.8 cannot be enforced as to a particular claim or request for relief, that claim or request, and only that one, will be decided in court, after the arbitration of all other claims, and the court case will be paused until the arbitration is complete.

14.9 Opting out. You may opt out of this agreement to arbitrate by emailing support@finitephone.com from the address on your account, or by mailing a letter to the address in section 16, within 30 days after you first accept these Terms. Your message only needs to say that you opt out of arbitration. We will confirm by email. If you opt out, neither of us can require the other to arbitrate, section 14.8 does not apply to you, and Disputes will be resolved in small claims court or in the courts described in section 15.2. Opting out changes nothing else in these Terms. Each person can opt out only for themselves.

14.10 Changes to this section. If we change this section 14 after you accept it, the change will not apply to any Dispute that began before the change takes effect, including a Dispute raised in a notice of dispute or filed before then. A change to your disadvantage will apply to you only if you accept it; otherwise, the version of this section 14 that you last accepted continues to apply.

14.11 California residents. If you live in California, then for a claim that arose in California: California law applies to the claim to the extent it would apply without these Terms; any in-person hearing takes place in California; you have the discovery rights that California law gives parties to an arbitration; and you may bring the claim in small claims court in California if it qualifies.

14.12 Conflicts. If anything else in these Terms or in any other document from us conflicts with this section 14, this section 14 controls.

15. General terms

15.1 Changes to these Terms. We may change these Terms. If a change is material, we will email you at least 30 days before it takes effect, stating the change, the date it takes effect, and how to cancel. A change to your disadvantage takes effect for you on its effective date or your next renewal date, whichever is later, or earlier if you accept it, so the Subscription Year you have already paid for continues under the Terms you accepted. A change that the law requires, or that only benefits you, may take effect sooner. We will not apply to you a change that lengthens any delay in section 7 or 8, or that reduces our liability under section 13, unless you accept it, for example by ticking a box on your account page. Section 14.10 governs changes to section 14. If you do not agree to a change, you may cancel before it takes effect. Every version of these Terms stays available at finitephone.com/terms/archive/.

15.2 Governing law and courts. These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules, and section 14 is governed by the Federal Arbitration Act. You keep the protection of any consumer protection law of the state where you live that cannot be waived by agreement. Except for claims that go to arbitration or small claims court under section 14, and for proceedings to enforce an arbitration award or to decide a question that section 14 leaves to a court, any Dispute will be decided in the state or federal courts in King County, Washington, unless the law of the state where you live gives you the right to bring it in a court there.

15.3 Electronic records. By subscribing, you agree that we may provide these Terms, receipts, renewal reminders, notices, and our other communications about Finite Phone electronically, by email to the address on your account or on your account page, and that they satisfy any legal requirement that they be in writing. This consent covers all such communications for as long as you have an account. To receive and keep them, you need a current web browser and an email account that can open HTML email and PDF files. You may ask for a paper copy of these Terms or of any notice by emailing support@finitephone.com or writing to the address in section 16, and we will send it without charge. To change the email address on your account, email us from your current address, and we will help you move your account. You may withdraw this consent by emailing us; because Finite Phone is provided electronically, we will treat that as a cancellation under section 3.7.

15.4 Notices. We give notices to you by email to the address on your account, and some notices also appear on your account page. You give notices to us by email to support@finitephone.com or by mail to the address in section 16.

15.5 Assignment. You may not transfer these Terms or your Subscription. We may transfer them only to a successor to the business that provides Finite Phone that agrees to be bound by them, and we will email you if we do.

15.6 Events beyond our control. We are not responsible for delays or failures caused by events beyond our reasonable control, such as outages of internet, cloud, or payment services, changes that Google makes to Android or its services, natural disasters, or acts of government. If such an event stops Finite Phone from working on your phone for more than 30 days in a row, you may cancel and we will refund the unused part of your Subscription Year. This section does not affect your right to cancel, to receive a refund owed under these Terms, or to remove Finite Phone by a factory reset.

15.7 Severability. If any provision of these Terms is found unenforceable, it will be enforced to the extent permissible, and the rest of these Terms will remain in effect, except as section 14.8 provides.

15.8 No waiver. If either of us does not enforce a provision of these Terms, that is not a waiver of the right to enforce it later.

15.9 Entire agreement. These Terms, together with the order details shown at checkout, are the entire agreement between you and us about Finite Phone, and they replace any earlier agreement on that subject. These Terms do not give rights to anyone other than you and us.

15.10 Interpretation. Headings and the Key terms summary at the top of these Terms are for convenience only and do not change the sections. "Including" means "including without limitation." A reference to a section is to a section of these Terms.

15.11 Your reviews. Nothing in these Terms limits your right to publish reviews of Finite Phone or to say what you think about us.

15.12 California users. Under California Civil Code section 1789.3, California users are entitled to the following notice: you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
